ReReadery Intellectual Property Policy

ReReadery is committed to respecting and protecting intellectual property rights in compliance with South African law, including the Copyright Act, 98 of 1978, and related international agreements to which South Africa is a party. This Intellectual Property Policy outlines the expectations, responsibilities, and rights of ReReadery, its users, and third parties in relation to intellectual property on the ReReadery platform.
By using ReReadery, users agree to comply with this Intellectual Property Policy, as well as the platform's Terms of Service, Seller Agreement, and other applicable policies.

1. Scope of the Policy
1.1 This policy applies to:
1.1.1. Sellers listing and selling books and related content on ReReadery.
1.1.2. Users submitting, uploading, or sharing content, such as reviews, images, or descriptions.
1.1.3. Third parties alleging violations of their intellectual property rights in connection with content on ReReadery.
1.2 Intellectual property covered by this policy includes, but is not limited to:
1.2.1. Copyright-protected works, including book content, images, and descriptions.
1.2.2. Trademarks, logos, and branding elements.
1.2.3. Any other proprietary material as defined under applicable intellectual property laws.
2. Ownership of Intellectual Property
2.1 Content Provided by Users
2.1.1. Users retain ownership of the intellectual property rights to any content they create and upload to the platform, such as book descriptions or photographs.
2.1.2. By uploading content, users grant ReReadery a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute the content for purposes related to platform operations and marketing, in compliance with the Terms of Service & the Service Level Agreement for Sellers.
Platform Content
2.2.1. All content developed and hosted by ReReadery, including the website design, text, graphics, logos, and software, is the exclusive property of ReReadery and is protected by applicable copyright, trademark, and other intellectual property laws.
2.2.2. Users may not copy, reproduce, distribute, or create derivative works from ReReadery's content without explicit written permission.
3. User Responsibilities
3.1 Prohibited Actions
Users are strictly prohibited from:
3.1.1. Listing counterfeit or pirated books.
3.1.2. Misrepresenting or infringing upon another party's intellectual property rights.
3.1.3. Using copyrighted material (e.g., images, book descriptions) without proper authorization.
3.2 Accuracy and Authorship
Sellers must ensure that:
3.2.1. Listings accurately describe the book and its condition.
3.2.2. Any images or content they upload are either original or used with proper authorization.
3.3 Indemnity Clause
Users agree to indemnify and hold ReReadery harmless from any claims, damages, or legal actions arising from intellectual property violations related to their content or listings.
4. ReReadery's Role and Responsibilities
4.1 Content Moderation
ReReadery reserves the right to:
4.1.1. Review and remove content that violates intellectual property rights or this policy.
4.1.2. Suspend or terminate accounts found repeatedly infringing intellectual property rights, in accordance with our Terms of Service and Content Moderation Policy.
4.2 Responding to Complaints
ReReadery will investigate complaints of intellectual property infringement and take appropriate action, including content removal or account suspension, as necessary.
5. Reporting Intellectual Property Infringements
5.1 How to Report
To report a violation, the complainant must provide the following information:
5.1.1. A detailed description of the allegedly infringing content, including URLs or listing IDs.
5.1.2. Proof of ownership or authorization to act on behalf of the intellectual property owner.
5.1.3. Contact details, including name, email, and phone number.
5.1.4. A statement affirming that the information provided is accurate and that the complainant believes in good faith that the reported use is unauthorized.
5.2 Submission of Complaints
Complaints should be submitted to admin@rereadery.co.za. ReReadery will acknowledge receipt within 3 business days and provide updates throughout the investigation.
6. Investigation and Action
6.1 Initial Review
ReReadery will review the complaint and contact the alleged infringing user for their response within 7 business days of receiving the complaint.
6.2 Resolution
Based on the evidence provided, ReReadery may:
6.2.1. Remove or disable access to the infringing content.
6.2.2. Suspend or terminate the user's account if repeated or serious infringements are identified.
6.2.3. Notify both parties of the outcome of the investigation.
6.3 Appeals
If a user believes their content was removed in error, they may submit an appeal within 7 business days of receiving the decision. Appeals will be reviewed by senior ReReadery personnel, and a final decision will be provided within 10 business days.
7. Repeat Infringers
Users who are found to repeatedly infringe intellectual property rights will have their accounts permanently terminated. ReReadery maintains a record of violations to identify repeat offenders.
8. Limitations of Liability
ReReadery is not liable for intellectual property violations committed by users of the platform. However, we will take reasonable steps to address violations once notified.
9. Changes to This Policy
ReReadery reserves the right to update this policy at any time. Any changes will be effective upon posting a revised version on the platform. Continued use of the platform constitutes acceptance of the updated policy.
